Terms & Conditions
TERMS OF SALE: Purchase of any product(s) and service(s) sold by (GCSL) shall be subject to and particularly limited by the terms and conditions contained herein. No changes to, waiver of, or addition to any of these terms and conditions shall be effective unless agreed to in writing and signed by Globe Computer Systems Ltd (GCSL).PRICES: Prices are quote in Malawi kwacha converted at the prevailing rate of exchange to US$ at the time of submitting the quotation. Prices are subjected to change prior to acceptance of customer order or payment in the event of a significant exchange rate fluctuation.
PRICE VALIDITY:
Unless prices are changed by (GCSL) in accordance with these terms,
prices are valid for the period set forth in a transaction document.
Product prices for a quotation remain valid for ten (30) days from
original order date unless otherwise quoted by (GCSL). After expiry of
this period, it is subject to our confirmation.
TAXES:
All goods and services will attract 16.5% VAT with the exception for
those entities that are surtax/ duty exempt. In such cases the customer
will require to submit duly completed and stamped documents by the
Malawi Revenue Authority (MRA).
PAYMENT TERMS: Payment terms are “Payment on delivery” for normal transactions. However for long valued customers that maintains an account with GCSL, payments will be 30 days from date of invoice. All delayed payments more than 30 days will attract a 4% interest charge without notification.
WARRANTY
LIMITED WARRANTY: GCSL warranty statements for computer hardware devices, server hardware devices, UPSs, printers and other selective devices are contained in their respective sections of these terms. The limited warranties in these terms are subject to the terms, limitations, and exclusions contained in the limited warranty statement provided for the product in the location where it used and when the warranty claim is made. These warranties can be subjected to change if specifically indicated. In such cases, special warranties and provisions may apply in consequently with tender specifications and will be highlighted in tender bid documentation.
Warranty
will be void if in the opinion of the company’s technical personal the
machines or equipment was found faulty due to the negligence of the
customer, customer or third-party media, software, interfacing,
supplies, or other products, modifications not performed or authorized
by GCSL, virus, infection, worm or similar malicious code not introduced
by GCSL, any machines or equipment failure due to fire, riots, strikes,
civil commotion, floods, excessive / over-load of power of ESCOM or any
direct power supply / voltage fluctuations beyond specifications,
lightning caused by atmospheric conditions or any other acts of God.
OTHER TERMS AND CONDITIONS
GCSL reserves the right to change the terms and conditions of sale. No Globe Computer Systems Ltd (GCSL) employee or agent has the authority to vary any of the GCSL policies or the terms and conditions ruling any sale(s).
